>> very bad. a >> catherine: now at five -- a family in mourning. tonight, new video -- as we learn more about what led to a traffic stop that ended with 2 by-standers dead and 2 others hurt -- including the suspect. good evening -- i'm catherine heenan. the crash happened on new years day. when the suspect fled police - he slammed into another car - forcing it into a liquor store. the story. >> reporter: heavy sobs coming from a sister of francisco gutierrezthe 26 year old pedestrian killed in the new year's day crash the grief stricken family and friends.leave more candles and flowers at the growing memorial here at the corner of 21st and south van ness where he and another innocent victim lost their lives.and a thrid was hospitalized. one of francisco's brothers say this loss is very difficult for them. >> very difficult >> reporter: here you can see new video shot by a witness that shows the chaos moments after the

accident happened just before 8am new year's day. police say the driver of the black chevy was fleeing a traffic stop.when he t boned the white toyotasending that of a liquor store.killing francisco who was on the sidewalk a 29 year old female passenger inside the toyota was also killed. the driver of the toyota18 year old juan fernando garciatunwas transported to sf general where he remains in serious condition. police have now identified the driver of the suspect car as 19 year old david moraleswho you see here in these imagescaught by a witnessas he's being taken into custody as well as being treated for the minor injuries he sustained. police say moralesa felon and a gang memberhad just fired a handgun at three people inside a housing project at 14th and valencia. it was after being stopped by police in connection with that shooting.that he took offand caused this deadly smash up. a handgun was recovered inside his vehicle. morales is now out of the hospital felony chargesincluding three

counts of attemped murder for the eariler shootingand two counts of murder for those who lost their lives on this street corner. maureen kelly kron4 news. we now know that the man swept out to sea and killed in point reyes -- was from richmond. this is video from sky-7 yesterday -- as the coast guard was retrieving his body. 59-year-old charles quaid was trying to help his wife and dog - after they were knocked over by a wave. charles was hit by another wave - and never made it back to shore. the point reyes tragedy isn't the only deadly incident involving big waves. kron4's charles clifford shows us the danger. >> reporter: on december 28th, two men and a young boy were swept by waves into the waters just west of the golden gate bridge. one of the men was able to swim

ashore and call for help. this is video from the scene taken by sky7hd abc7 news. unfortunatley, the other man and the nine year old boy died. >> is a good idea not to turn your back on the ocean. >> reporter: on new years day, 59 year old charles quaid and his wife were also caught by waves while walking their dog along the beach in pt reyes. quaid was washed out to sea, his body recovered several hours later. >> the odds of him getting hit in the winter are her more increased because of the swells from alaska. it's a good thing not to >> reporter: the national park service says that anyone who is especially this time of out for trouble. the danger of being hit by a winter, increases because of the big swells from alaska. >> reporter: they also reccomened avoiding slippery rocks or debrie near the ocean. they say beach goers should stay at least 30 yards away from the waters edge and avoid swimming. >> they also ask that children be closely supervised. yourself, your friends and your family to be aware of the hazards in case they are not. >> in marin county, charles clifford kron 4 news.

this also extends unemployment benefits with 2 million people that are currently out of work for six more months. and spending cuts will be delayed but that lack of spending cuts is causing the republicans to vote against the measure. >> the senate, the president of the vice president have failed to meet their own stated obligation wish to bring our balanced bill that had tax adjustments. and also had spending adjustments and the swan fills out that. , the stock market surged on the heels of their agreement on wednesday there are future of land mines. in two months, that $109 billion in spending cuts will be triggered again. unless congress and that the president can come up with a mutual agreeable plan. and in three months, they will have a debt ceiling dilemma

>> catherine: thank you, dan. san francisco police have named the man arrested in yesterday's crash that killed two people and injured two others. 19 year old david morales is out of the hospital and in jail. police say the convicted felon is an active gang member and is facing charges including two count of murder and three counts of attempted murder. he's accused of causing this crash as he fled from police after a traffic stop. police say he was pulled over because he fit the description of a man who had fired at three people at a housing project at 14th and valencia. police say he sped off and crashed into the white toyota. which hit and killed a pedestrian before slamming into a liquor store at 21st and south van ness. a 29-year old woman who was a passenger in the toyota was killed. the 18 year old driver was badly injured.. kron4's maureen kelly has new information on the pedestrian who was killed.
